GALLIPOLIS — Robert H. Erwin pled guilty to three counts of unlawful sexual conduct with a minor in Gallia County Common Pleas Court on Monday.
Erwin, 67, Gallipolis, was indicted by Gallia County grand jurors in June after allegations arose that he had molested at least a dozen boys dating back to the 1980s, at which time he was little league coach in Gallia County. In addition, a bill of information was filed last month charging him with two counts of unlawful sexual conduct with a minor.
All charges against Erwin addressed Monday were in regard to incidents that involved a 13-year-old male victim between April and May 2009.
When asked by Common Pleas Court Judge D. Dean Evans if he was in fact guilty of these crimes, Erwin replied, “Yes.”
Pursuant to his guilty plea, Gallia County Prosecutor Jeff Adkins agreed not to file any other charges of a similar nature against Erwin in regard to any other alleged victims. The plea agreements stipulate that Erwin be sentenced to five years per count and that the sentences be served consecutively.
Unlawful sexual conduct with a minor is punishable by one to five years in prison, a $10,000 fine, three years of post-release control, and classification as a Tier II sexually oriented offender. By pleading guilty, Erwin not only waived his right to trial, but also appeal.
Evans accepted Erwin’s guilty plea, though he advised that he is not obligated to honor the underlying plea agreements. He continued the matter for sentencing following the completion of a pre-sentence investigation.
A hearing will likely be scheduled within the next 30 days.
