GALLIPOLIS — A young man was recently indicted in Gallia County Common Pleas Court in connection with three separate theft-related offenses.
Brandon M. Smith, 18, address unknown, has been charged with two counts of burglary and one count of breaking and entering.
According to his indictment, count one alleges that on or about Jan. 17, Smith did trespass in the habitation of Nicholas W. Hunt, when Hunt was present or likely to be present, with purpose to commit in the habitation a criminal offense.
Count two alleges that on or about Jan. 19, Smith did trespass in The Down Under Restaurant with purpose to commit a theft offense.
According to count three, it is alleged that on or about Feb. 3, Smith trespassed in the habitation of Randy Ratcliff, when Ratcliff was present or likely to be present with purpose to commit in the habitation a criminal offense.
Smith pled not guilty to the charges and was release on his own recognizance under a $45,000 bond with an additional bond set at $1,000 ten percent secured.
His jury trial is scheduled for Aug. 18 at 9 a.m.
Other indictments recently unsealed include:
• Nicholas J. Pelfrey, 32, Mount Tabor Road, Vinton, has been charged with one count of tampering with evidence for allegedly providing a false urine screen to a TASC officer on or about July 22, 2008.
He pled not guilty to the charge and was released on his own recognizance under a $15,000 bond with an additional bond set at $1,000 ten percent secured.
His jury trial is scheduled for July 15 at 9 a.m.
• Margaret A. Howell, 38, 1529 McCormick Road, Lot 11, Gallipolis, has been charged with two counts of forgery and two counts of identity fraud.
She is charged with forgery for allegedly with purpose to defraud, issuing two writings on the account of Margaret Rollins in the amounts of $235 and $137 on or about Sept. 21 and Sept. 25, the said Howell knowing them to have been forged.
The identity fraud charges allege that she obtained the personal identifying information of Sherry Smith with the intent to represent the information as her own on or about Sept. 21 and Sept. 25, the value of said credit, property, services, debt, or other legal obligation involved being less than $500 on each count.
Howell pled not guilty to the charges and was released on her own recognizance under a $20,000 bond with an additional bond set at $1,000 ten percent secured, although she is currently incarcerated in the Marysville Women’s Prison on a separate charge.
Her jury trial is scheduled for Aug. 27 at 9 a.m.
Cases recently dismissed include:
• The case of Chad E. Long, 29, 3001 Ohio 141, Gallipolis, was dismissed for the reason that he already pled to the underlying charge in Gallipolis Municipal Court. He had been charged with carrying concealed.
• The case of Raymond A. O’Banion, 47, Dayton, was dismissed on good cause shown. He had been charged with having weapons under disability.
