GALLIPOLIS — A Gallia County man who was ordered to successfully serve a two-year probation term, recently had his community control revoked and was sentenced to serve a term in a state prison.

Joshua Lee Ramey, 32, Gallipolis, was sentenced last week to serve a total of 30 months in the Ohio Department of Rehabilitation and Correction.

Ramey was indicted in December 2011 on a charge of burglary and theft after he allegedly entered a residence located on Plas Road in Raccoon Township between November 15, 2011, and November 28, 2011, and stole four firearms belonging to the homeowner.

The defendant was arraigned on these charges on December 19, 2011, and was held in the Gallia County Jail on a $30,000, 10 percent bond.

Ramey later pleaded guilty to count two of the indictment — theft — on March 5, 2012, and, on a motion of the defense, his bond was reduced, and he was later released on his own recognizance.

On March 27 of last year, Ramey was sentenced to 24 months of community control and ordered to successfully complete the SEPTA (Southeastern Probational Treatment Alternative) program at the SEPTA facility in Nelsonville.

He was further ordered to pay restitution in the amount of $2,000 to the victim.

On November 6, 2012, probation violations in this case were filed by the defendant’s probation officer alleging that he had failed to report to the Spectrum Outreach Program, tested positive on October 24, 2012, and November 1, 2012, for illegal drugs, failed to report his arrest by the Gallipolis Police Department on November 1, 2012, for disorderly conduct, and was intoxicated at the time of his arrest.

He was arraigned on these violations on November 6, 2012, and was released on an own recognizance bond.

A final hearing in this matter was later continued to January 31, 2013.

During the hearing last Thursday, Ramey’s probation was revoked, and he was sentenced to 30 months of imprisonment.

According to the journal entry filed following the final hearing in this case, the defendant was “specifically notified that a violation of his community control would result in imprisonment for thirty (30) months.”

Ramey was given credit for a total of 256 days served and any further custody days while awaiting transportation to a state prison.

The defendant was also ordered to pay the cost of prosecution.
