GALLIPOLIS — An area man was sentenced to community control in Gallia County Common Pleas Court on Monday after he pled guilty to one count attempted burglary.
Jeremiah H. Harkins, 26, 1508 McCormick Road, was charged with attempted burglary following an incident on March 13 in which he did purposely or knowingly and with sufficient culpability for commission of a burglary, engage in conduct that if successful would have constituted or resulted in a burglary.
The court honored a plea agreement entered into by Harkins and the state of Ohio that was made on the recommendation of the victim.
He was further ordered to an evaluation by Spectrum Outreach Services, 500 hours of community service with all but 60 hours stayed, register with Ohio Employment Services, pay all costs of the prosecution, and have no contact with the victims.
An accomplice to Harkins in the commission of this offense pled guilty to complicity and received the same sentence in November.
Indictments recently unsealed include:
Ayla Gibbs, 20, Apartment 84, 381 Buck Ridge Road, Bidwell, has been charged with one count burglary for allegedly trespassing in the permanent or temporary habitation of Steve Forgey by force, stealth, or deception on or about Oct. 22, when Forgey was present or likely to be present, with purpose to commit in the habitation a criminal offense.
Gibbs pled not guilty to the charge and was released on her own recognizance under a $20,000 bond with an additional bond set at $1,000 ten percent secured.
Her jury trial is scheduled for April 20, 2009 at 9 a.m.
Richard E. Ellis, 37, 79 Solar Drive, Gallipolis, has been charged with one count each receiving stolen property, breaking and entering, and theft.
According to count one of the indictment, it is alleged that on or about April 14, he did receive, retain, or dispose of a walk pick, property of Paul McCormick/Ohio Valley Plastering, with Ellis knowing or having reasonable cause to believe said property had been obtained through the commission of a theft offense.
Counts two and three allege that Ellis did knowingly trespass on the land or premises of Michael Northup with purpose to deprive Northup of aluminum wheels and a semi wheel on or about Aug. 29.
Ellis pled not guilty to the charges and was released on his own recognizance under a $15,000 bond with an additional bond set at $1,000 ten percent secured.
His jury trial is scheduled for April 28, 2009 at 9 a.m.
