Plea changes lead to prison sentences

GALLIPOLIS - Several cases were recently resolved after defendants entered plea changes in Gallia County Common Pleas Court last week.

Adam Boggess, 31, Gallipolis, was indicted by the grand jury in August of 2007 on one count of escape, a felony.

According to court records, on July 27, 2007, while meeting with a probation officer, Boggess was informed that there was a warrant for his arrest in Gallipolis Municipal Court for failure to appear at a show cause hearing. After being told that if he did not have the bond money then he would go to jail, Boggess fled the Gallipolis City Building when the probation officer went into the restroom to collect a urine screen.

After initially pleading not guilty Boggess pled guilty to escape in Common Pleas Court last Tuesday.

He was sentenced to eight months incarceration at the Ohio Department of Rehabilitation and Correction to be served concurrently with another case in Athens County Common Pleas Court.

Roger L. Bush Jr., 42, 38 Smithers St., Gallipolis, who was indicted for theft by the grand jury last February, also entered a plea change last week.

According to court records, Bush with the purpose to deprive Wal-mart, the owner, knowingly obtained or exerted control over miscellaneous merchandise with a value of approximately $700.

Bush pled guilty to the theft charge in Common Pleas Court and was sentenced to 12 months incarceration in the Ohio Department of Rehabilitation and Correction.

William R. Lewis, 52, 544 Lewis Road, Gallipolis, also changed his plea to guilty last week.

He was indicted last August on two counts of possession of drugs and one count of trafficking in drugs.

According to court records, Lewis possessed and knowingly sold or offered to sell 819 grams of marijuana and also obtained, possessed or used less than one gram of crack cocaine.

On Jan. 29, Lewis pleaded guilty to one count of trafficking in drugs and one count of possession of drugs. The court accepted his guilty plea, though they are under no obligation to accept the plea agreement, which recommended five years of community control, restitution of $4,797 and $10,000 and the forfeiture of a six foot by three foot liberty gun safe to Gallia County Prosecutors.

Sentencing for Lewis is scheduled for Feb. 22, 2008 at 2:30 p.m.
