Court sets $2M bond for shooting suspect

GALLIPOLIS — Bond was set at $2 million for a man accused of wounding two individuals in a Jan. 4 shooting incident following his arraignment Tuesday in Gallipolis Municipal Court.

Daries D. Pemberton, 31, 3546 County Road 64, Willow Wood, has been charged with two counts of attempted aggravated murder, two counts of felonious assault, two counts of aggravated burglary and one count of abductrion.

All of the charges arose out of an incident at residences on Ohio 233 near Gallia. Tammy Christian, 23, and Victor Hayslip, 83, were wounded by gunshots allegedly fired by Pemberton, Gallia County Prosecuting Attorney Jeff Adkins said.

Christian and Hayslip were airlifted to St. Mary’s Medical Center in Huntington, W.Va., where at last report they were in stable condition.

Attempted aggravated murder and aggravated burglary are first degree felonies, Adkins said. Felonious assault is a second degree felony, and abduction is a third degree felony.

Pemberton appeared by video from the Gallia County Jail for his initial appearance in municipal court. Judge Margaret Evans set bond at $2 million-10 percent and ordered that Pemberton be restrained from the victims.

Evans also scheduled a preliminary hearing for Tuesday, Jan. 15 at 8:30 a.m. and appointed Gallipolis attorney William Dean Conley as counsel for Pemberton, who was originally reported as residing at a Gallia-area address.

Although details of the incident are not being released at this time, the prosecutor’s office commended officers from the Gallia County Sheriff’s Department, State Highway Patrol, Rio Grande Police Department, Oak Hill Police Department and Jackson County Sheriff’s Department for their handling of the incident.

Authorities said Pemberton was taken into custody without incident shortly after officers’ arrival at the scene following initial notification by Gallia County 9-1-1 at 5:13 p.m.

The scene was processed by detectives of the Gallia County sheriff’s office and agents of the Ohio Attorney General’s office-Bureau of Criminal Identification and Investigation.

The suspect’s automobile was located in a rural area near the crime scene and processed by detectives and deputies on Saturday, Adkins said. Detectives and crime scene agents returned to the original scene on Tuesday for further processing. Personnel from the Gallia County prosecutor’s office also assisted detectives throughout the weekend.
