Prison sentence closes Cliffside theft case

GALLIPOLIS — On Tuesday, Dahryl Justin Keller, 22, 570 Blessing Road, was the third and final suspect to plead guilty to charges against him in connection with a theft that occurred at Cliffside Golf Club on Dec. 28, 2006.

Keller, who was indicted on Feb. 7, 2007 for complicity to breaking and entering and safecracking pleaded guilty to both charges in the Gallia County Common Pleas Court and was sentenced to the Ohio Department of Rehabilitation and Correction for a total of two years; seven months for complicity and 17 months for safecracking, ordered to be served consecutively.

Joshua D. Queen, 24, 189 Daft Road, Patriot, pleaded guilty in May on charges against him and was also sentenced to prison. Originally indicted on Feb. 7, 2007 on two counts of breaking and entering (one count for the golf course and another count for a separate incident), two counts of theft and one county of safecracking, Queen pleaded guilty to two counts of breaking and entering and one count of safecracking.

In consideration of the plea, the two counts of theft were dropped.

Queen was sentenced to the Ohio Department of Rehabilitation and Correction for a total of two years; seven months for one count of breaking and entering and 17 months for safecracking, to be served consecutively and 11 months for the other breaking and entering charge, ordered to be served concurrently.

Queen was also ordered to pay restitution.

The third suspect, Gwenda L. Dyer, 22, 259 Blessing Road, Patriot, pleaded guilty to attempted complicity to breaking and entering, a lesser offense than the original charge of complicity to breaking and entering.

She was ordered to pay a $1,000 fine and pay restitution to Cliffside Golf course.

Two other 2007 cases were recently dismissed at the request of the state. They were:

  • The case against Belinda A. Cook, 32, 638 Jim Lackey Road, Thurman, who was indicted on March 23, 2007 for theft was dismissed pending further negotiations.

  • The case against Nathan Halley, 21, 1040 Second Ave., Gallipolis, who was indicted on Feb. 7, 2007 for burglary was dismissed because a key witness for the state was not available for the trial.

    Two grand jury indictments were also recently unsealed. They are:

  • Leon D. Queen, 30, 3790 Ohio 218, Crown City, was indicted on March 23, 2007 for receiving stolen property for allegedly receiving, retaining or disposing of telephone wire belonging to SBC knowing or having reasonable cause to believe the property had been obtained in the commission of a theft offense.

  • Russell W. Cox, 32, Pedro, was indicted on Oct. 19, 2006 for possession of drugs for allegedly knowingly obtaining, possessing or using .176 of a gram of cocaine.
