Ex-Gallia jailer pleads guilty to rape charges

GALLIPOLIS - A former Gallia County corrections officer who is serving time for sexual offenses against a child pleaded guilty Tuesday to three additional counts of rape as part of a plea bargain.

Shawn Burton, 30, is serving a sentence of life plus 32 years after having been found guilty on five counts of gross sexual imposition, three counts of rape and one count of kidnapping in December 2004.

On Tuesday, visiting Common Pleas Judge Frederick W. Crow III of Meigs County sentenced Burton to two 10-year terms and one five-year term. The two 10-year sentences will run concurrently with the life-plus-32-years sentence he is now serving. The five-year sentence will be served afterward, Crow ordered.

The sentence means Burton will not be eligible for parole until 2031.

The 2004 case involved one victim, while Tuesday's plea bargain involved a second, said Erin Rosen, assistant special prosecutor for the case.

Under the agreement, Burton pleaded guilty to three counts of rape in return for dismissal of nine additional charges.

The prosecution agreed to ask for five years on each of the three counts, with two sentences running concurrently with the sentence for the 2004 conviction and one added to the end.

Crow doubled the sentence on two of the counts, but the net effect will remain the same in that Burton will end up serving an additional five years in prison.

During Tuesday's hearing, Cynthia Reagan Kuhr of the Ohio Victim Witness Association read two victim impact statements to the court. One was from the victim.

“I am angry because you hurt people,” Kuhr read. “You should have been more responsible especially since you were a cop.”

The second statement was from the victim's parents.

“Shawn Burton. For over two years you never did the right thing ... We saw you laugh, smile and gloat during your first trial.”

In the statement, the parents told Burton not to apologize. He did, however.

“I'm here to take responsibility for my actions,” he said. “I know after that letter that they won't accept it, but I still want to say I'm sorry for everything. They won't accept it, but I mean it from the bottom of my heart.”

Crow was appointed as the special judge in the case to avoid potential conflicts because Burton was a Gallia County Sheriff's Office employee at the time of the offenses.

Scott A. Longo, of the state Attorney General's Office, was appointed special prosecutor for the same reason. Rosen was named assistant special prosecutor.

Prosecutors agreed to the plea bargain because it will guarantee Burton will remain in prison for several more years, Rosen said. Burton currently is appealing his 2004 conviction.

Now, even if it is overturned, he still will have to serve 25 years, she said.

Additionally, Burton waived his right to a sexual predator hearing, meaning he will be required to register as a sex offender in the community in which he lives for the rest of his life.
