Gallia Co. men facing drug charges

GALLIPOLIS — Two Gallia County men were recently arraigned in the Gallia County Court of Common Pleas following the search of a residence in Gallipolis and their subsequent arrest by officers with the Gallipolis Police Department in January.

Brennan J. Duty, 19, Gallipolis, was arraigned on one count of drug possession on Feb. 15 in the common pleas courtroom after he was allegedly in the possession of 39, 20 milligram Opana tablets on Jan. 5, 2011.

Christopher T. Dray, 27, Gallipolis, was arraigned on one count of drug possession on Feb. 16 after he was allegedly in the possession of one half of an Opana tablet on Jan. 5, 2011.

Duty and Dray were arrested, along with John S. Burke, II, 30, Gallipolis, and Charles McBrayer, 30, Gallipolis, by officers with the Gallipolis Police Department on Jan. 5 after officers conducted a probation search of a residence located at 22 Neil Ave.

McBrayer was taken into custody at the scene on an outstanding warrant and Sean R. Stiles, 20, Galloway, Ohio, was cited for marijuana possession.

Burke was arraigned on one count of drug possession on Jan. 25 in relation to this case. On the day in question, Burke was allegedly in the possession of one half of an Opana tablet. During his arraignment, Burke pleaded not guilty to the charge against him. He is scheduled to appear for a status conference in this matter on March 15.

Also, on Jan. 25, Burke pleaded guilty to one count of drug possession in a separate 2010 case after he was in the possession of four, 20 milligram Oxycodone tablets on July 23, 2010. Burke is scheduled to appear for sentencing in this matter on March 3.

In a second 2011 case, Burke was arraigned in the common pleas court on two counts of trafficking in drugs and two counts of drug possession on Feb. 16. Burke is scheduled to appear for a status conference in this matter on April 1. A negotiated plea agreement in this case may be filed by April 25 with the clerk of courts.

During his arraignment, Duty pleaded not guilty to the charge against him. The defendant is scheduled to appear for a status conference in his case on April 5. A plea agreement may be filed in this case by May 30.

Dray also entered a not guilty plea during his arraignment on Wednesday. A status conference in this case is scheduled for April 6. A plea agreement may be filed in this case by May 27.

Dray’s bond was set at $5,000 own recognizance with an additional bond of $1,500, 10 percent. Duty posted bond for his release on Wednesday, while Burke is currently being held in the Gallia County Jail under a $5,000, 10 percent bond with an additional bond of $1,500, 10 percent.
