Judicial release granted for convicted burglar

GALLIPOLIS — A Gallia County man was granted judicial release in the Gallia County Common Pleas Court after spending nine months in the Ross Correctional Facility for burglary.

Colby Richards, 25, Thurman, was ordered to be discharged from prison on Dec. 20 following a request for judicial release.

Richards burglarized a home located on Haskins Road in Green Township on May 23, 2008, and later plead guilty to that charge on June 17, 2009.

During his plea hearing, Richards was sentenced to two years of community control and further requested intervention through Spectrum Outreach Services for drug addition.

On March 8, 2010, community control violations were filed with the court after Richards tested positive for Oxycontin in a urine test on Feb. 5, 2010, and later had contact with law enforcement after he allegedly stole and forged one of his father’s checks.

On March 9, 2010, Richards plead guilty to the community control violations and was sentenced to 17 months of imprisonment.

A request for judicial release was filed with the court on Dec. 15 and, because the victims in this case did not object to judicial release and restitution had been received, Richards’ sentence was suspended.

Richards was further sentenced to 24 months of community control, ordered to pay $50 per month to the clerk of courts while on probation, ordered to pay the court costs and ordered to have no contact with the victims in this case. Richards must also register with Ohio Employment Services in an effort to obtain employment.
