W.Va. man charged with possession of 1,300 Oxycontin pills
GALLIPOLIS — A Huntington, W.Va., man has been charged with eight felony counts in Gallia County Common Pleas Court in connection with the possession and trafficking of more than 1,300 Oxycontin pills.
Jwan D. Brown, 27, was charged during the last session of the Gallia County Grand Jury with one count of tampering with evidence, three counts of possession of drugs, three counts of trafficking in drugs and one count of fleeing and eluding.
According to records carried over from Gallipolis Municipal Court, it is alleged that on or about Sept. 24, Brown attempted to flee from police after an officer tried to pull him over while he was driving eastbound on U.S. 35. In the process of fleeing, Brown was said to have reached speeds of 85 miles per hour or more. He reportedly drove his vehicle onto the exit ramp at U.S. 35 near Rio Grande and continued through the stop sign across Ohio 325 without stopping before resuming eastbound on U.S. 35 and passing two cars on the right prior to bringing his vehicle to a stop after fleeing for approximately three miles.
The charge of tampering with evidence alleges that before Brown brought his vehicle to a stop, he threw a bag of pills out of the automobile with purpose to impair its value or availability as evidence.
Brown is also charged with obtaining, possessing, or using 1191 80-milligram Oxycontin tablets, 110 40-milligram Oxycontin tablets, and 347 two-milligram Xanax tablets and preparing for shipment, ship, transport, deliver, prepare for distribution, or distribute said controlled substances, when he knew or had reasonable cause to believe that they were intended for sale or resale.
Brown pled not guilty to the charges and was released on his own recognizance under a $40,000 bond with an additional bond set at $1,500 10 percent secured.
His jury trial is scheduled for April 29, 2010 at 9 a.m.
Co-defendant Kaitlyn R. Collins, 22, Huntington, W.Va., has also pled not guilty to three counts each of possession and trafficking in drugs in connection with this incident.
Other indictments recently unsealed include:
• Daniel A. Crittenden, 28, Vinton, has been charged with one count of burglary for allegedly trespassing in the residence of Dottie Wiley by force, stealth, or deception between July 3-5, 2008, with purpose to commit a criminal offense.
He pled not guilty to the charge and was released on his own recognizance under a $15,000 bond with an additional bond set at $1,500 10 percent secured.
His jury trial is scheduled for April 8, 2010 at 9 a.m.
• Troy R. McDaniel, 43, Gallipolis, has been charged with one count violating a protection order for allegedly recklessly violating the terms of a protection order or consent agreement on or about Sept. 20, the said McDaniel having been previously convicted of a violation of a protection order in a 2006 Gallipolis Municipal Court case.
McDaniel pled not guilty to the charge and was released on his own recognizance under a $5,000 bond with an additional bond set at $1,500 10 percent secured.
His jury trial is scheduled for April 22, 2010 at 9 a.m.
• Thomas R. Mallette, 28, Point Pleasant, W.Va., has been charged with one count of theft for allegedly knowingly obtaining or exerting control over a 14-foot aluminum boat and a 2,000-foot welding lead on or about Aug. 25, 2006, with purpose to deprive O-kan Marine Repair, the owner.
Mallette pled not guilty to the charge and was released on his own recognizance under a $5,000 bond with an additional bond set at $1,500 10 percent secured.
His jury trial is scheduled for April 26, 2010 at 9 a.m.
